In this document we expose the return policy of Nova percusio, S.L. (hereinafter, NPdrums.com), which is legally established according to current regulations, and that the customer accepts each time he makes a purchase through our website.

In case of any possible claim, the customer must contact NPdrums.com, always and obligatorily providing, by phone or email, his name and surname, order number and date, and invoice number. Claims made by social networks, WhatsApp or any instant messaging service, chat, Messenger, video-chat, etc. will not be addressed. To obtain the good service we offer, customers must communicate by the means indicated, and always do so clearly, politely, and if it is in written form without spelling mistakes. We cannot guarantee good service if we cannot understand our customers.

The legislation offers solutions in defense of customers, and in many cases those solutions go through a long and expensive process of notifications and authorizations. We did not invent the law, but we have to abide by it. However, we can make returns in a much more agile and simple way, as long as the customer expressly expresses his goodwill and good work. For any claim, from NPdrums.com we recommend that the client ALWAYS contact by telephone before initiating any action, in order to be able to have proof of their demands and advise them regarding legislation and procedures. Otherwise, in this document, which the customer has accepted at the time of finalizing the order, the procedure is exposed, in detail, to file a claim.

IN ANY CASE, the warranty is automatically void when the customer handles the product on his own and without the express consent of NPdrums.com Damage caused by poor handling of the products, even due to ignorance, as well as disassembly, replacement of parts, or manipulations not carried out by authorized technical services, automatically void the warranty and the customer, When making the purchase, you must abide by the provisions of this point, even if you have not read it.

The guarantee is enforceable provided that the defects or malfunctions are manufacturing defects and are not derived from use. For this reason, in the case of some products such as Drumhead, drumsticks, mallets and accessories that may be damaged by the use of the customer, they have no warranty.

If the customer is going to handle any product purchased in NPdrums.com and has doubts about its use or operation, he must communicate it in a reliable and immediate way to NPdrums.com before taking any action on his own, and from here we will give him precise instructions so that the correct use without losing his right of guarantee. Similarly, in NPdrums.com we are not responsible for the damages that the products may suffer when they have been produced by a misuse of other components not acquired in NPdrums.com

LEGISLATION

NPdrums.com acts in accordance with regulatory legislation, which is composed of the following regulations:

- Law 7/1988, of 13 April, on General Contracting Conditions.

- Law 7/1996, of 15 January, on the Regulation of Retail Trade, Royal Legislative Decree 1/2007, of 16 November, approving the Consolidated Text of the General Law for the Defense of Consumers and Users and other complementary laws, modified by Law 47/2002 for the transposition into Spanish law of Directive 97/7/EC, in the field of distance contracts, and for the adaptation of the Law to various Community Directives.

- Law 7/1998, of 13 April, on General Contracting Conditions.

- Royal Decree 1906/1999, of 17 December 1999, which regulates Telephone or Electronic Contracting with general conditions.

- Organic Law 15/1999, of 13 December, on the Protection of Personal Data.

- Law 34/2002, of July 11, Services of the Information Society and Electronic Commerce.

- Law 23/2003, of 10 July, on Guarantees in the Sale of Consumer Goods.

- Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users and other complementary laws.

- Law 3/2014, of March 27, which modifies the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16.

In any case, the warranty of the products will always be 2 years from the date of purchase. NPdrums.com reserves the right to extend this period if the manufacturer and / or distributor grants a longer term.

CONDITIONS

There are THREE possible cases to return the product.

1- The product is defective in its entirety or we have sent a wrong product.
2- The product we have sent is not the one that the customer has requested, and by mistake NPdrums.com we have sent a different one, or the order is incomplete.
3- The customer has made a mistake when buying the product or has thought better of it and has decided to exchange it for another product or return it.

1- RETURNS FOR DAMAGE

The return period of the purchase is fourteen calendar days from the date of receipt of the product. If from NPdrums.com for whatever reason, we do not provide the consumer and user with information about the right of withdrawal, the term to withdraw from the contract will be extended until twelve months after the expiration date of the initial period. The law also regulates the obligations assumed by both parties to the contract in case of withdrawal, as well as the effects of the same with respect to complementary contracts. In this case, as the information is contained and clearly exposed in this section, and given that when the customer makes a purchase through the web, he is tacitly accepting these conditions, it is implicitly contained that he has read the terms and conditions and that he is informed.

The postage of the returns will be assumed by NPdrums.com whenever the product presents some type of damage, breakage, malfunction, etc., and is totally or partially defective. In that case, according to the specific conditions of each situation, either a collection by courier agency will NPdrums.com ordered at the customer's home, or the customer will first be responsible for the shipping costs of the defective product, and then those expenses will be reimbursed by NPdrums.com or by reimbursing said expenses by bank transfer, either by creating a discount coupon for a next purchase. The customer may also choose to exchange the amount of the shipping costs paid a priori for products, never exceeding the amount of the expenses The choice of one or the other option will be agreed in each case depending on the availability of the product, dimensions, weight, condition of the product, and each and every one of the specific circumstances that may surround each of the cases.

2- RETURNS FOR INCOMPLETE ORDERS OR WITH INCIDENTS.

Although the error rate is very low, there is a possibility of incidents occurring during the order preparation, manufacturing, packaging and shipping process. Both for the human part, in which we can make mistakes when performing a task, and in the technical part, which concerns the computer and logistical aspects and that may be subject to failures, in NPdrums we can make mistakes and send customers products that they have not requested. If the customer receives at home a product that he has not requested instead of another that he did buy, we assume our responsibility and we commit ourselves to the replacement of the wrong item with the correct one in the shortest time and always postage paid by the company.

If you receive the wrong product, you must contact us immediately so that we can correct the error. To do this, we recommend that you contact us by phone or email (not through WhatsApp, social networks or chat) and communicate your name, ID, order number and your incident. We will ask you to send us photographs of the product via email so that we can verify that, indeed, the product you have received is not the one you ordered. Once the checks have been carried out, and if we have indeed made an error, we will proceed to correct it. If the product we have not sent you is in stock, we will send you to a courier who will collect the wrong product and deliver the correct one, at no cost to the customer. If the product that we have not sent you is not in stock, we will contact you to agree on a solution that can be from refunding the money to replacing it with another product, waiting for it to be available again, etc. In any case, the client (obviously) will not have any type of expense, and we will always try to compensate him for the inconvenience caused.

There is also the possibility that your order is incomplete, and that, due to computer error or in the packaging and handling process, some product is not sent to the customer. In that case, the customer must contact us BY TELEPHONE, and indicate their name, ID, order number and their incident. From NPdrums.com we will proceed to send you, at no cost to the customer, the product not included, as quickly as possible, provided that the product is in stock. In the event that the product is not in stock, we will contact you to agree on a solution that can be from reimbursing the money to replacing it with another product, waiting for it to be available again, etc. In any case, the client (obviously) will not have any type of expense, and we will always try to compensate him for the inconvenience caused.

Right of withdrawal

You have the right to withdraw from this contract within 14 calendar days without justification.

The withdrawal period will expire 14 calendar days from the day that you or a third party indicated by you, other than the carrier, acquired material possession of the last of those goods.

your decision to withdraw from the contract through an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You can use the model withdrawal form below, although its use is not mandatory.

To comply with the withdrawal period, it is sufficient that the communication regarding the exercise by you of this right is sent before the corresponding period expires.

Consequences of withdrawal

In case of withdrawal on your part, we will refund all payments received from you,

including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the least expensive mode of ordinary delivery that we offer) without any undue delay and, in any case, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will proceed to make such reimbursement using the same means of payment used by you for the initial transaction, unless you have expressly provided otherwise; In any case, you will not incur any expenses as a result of the reimbursement. We may withhold reimbursement until we have received the goods, or until you have provided proof of the return of the goods, whichever comes first. 

You must return or deliver the goods directly to us or to C/ Balmes, nº 15 | 46940  Manieses (Valencia), without any undue delay and, in any case, no later than within 14 calendar days from the date on which you inform us of your decision to withdraw from the contract. The deadline will be considered fulfilled if you return the goods before the end of that period. [You shall bear the direct cost of returning the goods].

You will only be liable for the decrease in value of the goods resulting from handling other than that  necessary to establish the nature, characteristics and functioning of the goods.
